Who Is Eligible to File a Roundup Lawsuit?
Anyone who has been exposed to Roundup and has been diagnosed with an illness such as non-Hodgkin’s lymphoma may be eligible to file a lawsuit against Bayer/Monsanto. You do not necessarily need a medical professional to link your cancer to Roundup exposure. Evidence from experts and agencies that are already involved in these cases can be used to support your case.
How Much Money Can I Get in a Bayer Roundup Lawsuit?
To recover compensation from the Bayer/Monsanto, you must have suffered measurable harm that can be attributed to your exposure to Roundup. You can get money for any “damages” that you have experienced, including “economic” and “non-economic” losses. Economic damages include those that are easily quantifiable through out-of-pocket costs. Those include past and future medical expenses and lost income. Non-economic damages are more subjective, such as pain and suffering related to the Roundup-related health impacts. The exact amount of money you can get in a Roundup lawsuit depends on:
-
- The severity of your Roundup-related health problems
- Ongoing treatment and prognosis
- Prospects for a full recovery
- The impact of your illness on your ability to work
- How your illness affects your everyday life
- The pain and discomfort you have experienced
- Mental anguish and other negative effects of your illness and medical treatment
Some Roundup verdicts have also awarded punitive damages. This type of financial award does not compensate you for losses but punishes the defendant for wrongdoing. Since Roundup knows or should have known that their product was dangerous and failed to warn consumers, punitive damages are common in Roundup cases.
Does Roundup Cause Cancer?
There is conflicting information about whether Roundup is a substantial cause of cancer in people who have been exposed to it. Monsanto began manufacturing Roundup in the mid-1970s; however, it was not until 2015 that the World Health Organization’s International Agency for Research on Cancer (IARC) determined one of the weed killer’s components — glyphosate — was carcinogenic and could cause cancer. Despite this, Roundup’s manufacturer, originally Monsanto and now Bayer, continued to use dangerous chemicals that were used on and around crops, flowers, and ornamental plants that were purchased and used by consumers. The U.S. Centers for Disease Control CDC indicates that today nearly 80% of Americans have a measurable level of glyphosate in normal urine samples. The IARC concluded that glyphosate-based weed killers can cause cancer. However, in 2017, the U.S. Environmental Protection Agency (EPA) issued a statement saying the herbicide was not likely to cause cancer in humans. There are numerous other studies, including research published in 2019 by the University of Washington that associated Roundup exposure with a 41% higher risk of non-Hodgkin’s lymphoma.
What Type of Cancer Is Linked to Roundup?
Most of the plaintiffs who have filed Monsanto lawsuits have been diagnosed with non-Hodgkin’s lymphoma, which develops in the body’s disease-fighting lymphatic system. Common symptoms of non-Hodgkin’s lymphoma include:
- Swelling of the lymph nodes
- Fluid accumulation and swelling in the abdomen
- Shortness of breath, coughing, or wheezing
- Blood in the vomit or stool
- Swelling of the arms, face, and neck
- Urine flow blockage
- Bone pain
- Weight loss
- Fever that lasts more than 14 days
- Headaches
- Seizures
- Problems with vision
- Changes in mental status
- Facial numbness
- Problems with balancing
- Night sweats and chills
- Itching
- Weakness
- Fatigue
If you have been exposed to Roundup and have any of these symptoms, you should get screened for illness immediately. If you are diagnosed with non-Hodgkin’s lymphoma, a Roundup lawsuit lawyer can help you understand your options and determine if you are eligible for a Roundup settlement.
Roundup Cancer Lawsuits
Victims began filing lawsuits linking Roundup weed killer to certain cancers, including non-Hodgkin’s lymphoma, well before Bayer bought out Monsanto in 2018. That was the same year that a California jury found in favor of one of the first Roundup victims, Dewayne Johnson, a 46-year-old groundskeeper who handled weed killer frequently at work for the California school system. Mr. Johnson developed non-Hodgkin’s lymphoma due to Monsanto/Bayer’s use of glyphosate and the company failed to warn users of the risks. Bayer was ordered to pay Mr. Johnson $289 million in damages, which was reduced on appeal to $20.5 million. Since then, many other people have filed lawsuits against Bayer due to injuries they sustained because of the dangerous chemicals Bayer/Monsanto knowingly used in their weed killers. Many of those cases have been consolidated. In fact, one of the largest single consolidated “multidistrict litigation” (MDL) actions has been created in the U.S. District Court for the Northern District of California. In 2019, two juries in California awarded multi-million-dollar verdicts to plaintiffs who developed non-Hodgkin’s lymphoma after using Roundup for decades. However, in 2021, Bayer won its first trial involving a child who developed Burkitt’s lymphoma. The jury in that case found that the child’s illness was not substantially caused by the household’s use of Roundup.
Roundup Settlement News Today
Roundup continues to be sold today. There has not been a widespread product recall for the weed killer. However, some stores, such as Costco, have stopped selling products containing glyphosate. There is no warning or mention of the risk of cancer on Roundup labeling. However, Roundup does have warning labels stating users of the product should:
- Wear long sleeves, long pants, and socks
- Avoid breathing vapor or sprayed mist
- Wash hands immediately after using the product
- Remove clothing immediately
- Discard any clothing that becomes soaked in the product
In July 2021, Bayer announced that it would remove glyphosate from consumer products by 2023. New products will “rely on alternate active ingredients” pending approval from the EPA. In late 2021, the company began refusing settlement talks. However, in June 2022, the U.S. Supreme Court declined to hear Bayer’s appeal of a lower court ruling against the company. In July 2022, the only class action against Roundup settled for $45 million. That case’s claims were limited to the potential dangers of Roundup and not actual illnesses suffered by individuals who were exposed to the chemicals. The multi-district litigation consolidated cases are ripe for settlement. In fact, there is a $10.9 billion Roundup settlement agreement on the table in the MDL cases. A large amount of that would be set aside for future claims against Bayer/Monsanto for people who develop health problems in the future.

Is There a Roundup Class Action Lawsuit?
There was a class action against Bayer regarding inadequate product warnings of the health risks caused by Roundup. That settled for $45 million in July 2022. However, that case was limited to the potential dangers of Roundup and not actual illnesses that were suffered by victims. Currently, there is a $10.9 billion settlement agreement on the table in the Roundup MDL case.
